SLC ANNOUNCES RETROACTIVITY DATES FOR TARIFFED SERVICES

The Schools and Libraries Corporation today announced that tariffed services WILL NOT be retroactive to January 1, 1998, unless those services were received under a binding, written contract signed before the SLC Web Site opened on January 30, 1998. Instead, the discounts will be retroactive to the 29th day after the Form 470 was posted on the SLC web site. Apparently this decision was just handed down from the FCC.

In order to complete the Form 471, Items 15 and 16, for existing tariffed services, please follow these instructions: Column 3: List the tariff reference number (can be obtained from your telecommunications provider). Columns 4 and 5: Mark a "T" indicating that the service is being purchased from tariff and you have not actually signed a written contract. Column 7: Insert the date of the 29th Day that your Form 470 has been posted. (For example, if you posted your Form 470 for a tariffed service to the SLC web site on March 1, the first day that service would be eligible for discounts would be March 29.)

Discounts for purchases of NEW tariffed services will be retroactive to the date that the new service actually begins, which may be no earlier than the 29th day after the posting of the Form 470. In order to complete the Form 471, Items 15 and 16, for purchases of new tariffed services, please follow these instructions: Column 3: List the tariff reference number (can be obtained from your telecommunications provider). Columns 4 and 5: Mark a "T" indicating that the service is being purchased from tariff and you have not actually signed a written contract. Column 7: Insert the date upon which service did or will begin should (may be no earlier than the 29th Day after the posting of the Form 470.)

I have placed several calls to the SLC asking what guidance we should give to schools and libraries who already mailed their Form 471 under the assumption that the discounts would be retroactive to January 1, as their application now would be inaccurate.
