Year 2 Out of Window Applications
Message Posted November 21, 2000

If you filed a Year 2 Form 471 after April 6, 1999, but before March

31, 2000 (including the special March 2000 application window), that

application is known as an "Out of the Window Application." Although no

funds were available in Years 1 and 3 to fund out of the window

applications, there are funds available to fund many of those applications

in Year 2. Approx. $360 million was requested, and so far, about $220

million is available (the exact amount requested is not yet known because

not everyone has submitted BEARs or Invoices or Form 500's releasing Year 2

WITHIN the window commitments.)

Status:

* The SLD has data-entered more than 80% of Year 2 Out of the Window requests

* Many applicants have received their Receipt Acknowledgement Letters

* Many applicants already have received calls from PIA regarding their application.

* Funding Commitments are expected to flow beginning in December (after you've received a call from PIA).

And because the September 30, 2000 deadline has passed to spend any future

Year 2 Out of the Window commitments, the FCC has released an Order stating

that applicants that receive Year 2 Out of the Window Funding Commitment

Letters will have until September 30, 2001 to spend these funds.

What is the Priority for Spending These Funds?

1) All applications received between April 7, 1999 and March 1, 2000.

2) All March window 80-90% discount applicants that have never received E-rate discounts.

3) All March window 80-90% discount applicants that have previously received E-rate discounts.

4) March window applicants on a first-come, first-served basis (regardless of discount level or services requested).

Note: The November 20, 2000 deadline to submit 486's and BEARs of course

did not apply to these Out of the Window Requests. These applicants likely

will have until November 2001 to have these forms submitted.

Return Unspent Commitments!

Were you committed more funds than you actually spent in Year 2? Did

you project come in under budget? Did you decide not to proceed with a

funded project? If any of these situations pertain to you, I encourage you

to use the new Form 500 to release (or turn back) the unusable funds. You

may wonder why you'd bother, but we estimate that the summary of such

actions will release millions of Year 2 dollars -- funds that can then be

committed to out of the window applications. The form is available at:
