{"id":33555,"date":"2021-08-17T14:00:55","date_gmt":"2021-08-17T14:00:55","guid":{"rendered":"http:\/\/e-ratepaorg.local\/?p=33555"},"modified":"2022-05-12T14:45:59","modified_gmt":"2022-05-12T14:45:59","slug":"ecf-unmet-needs-documentation-guidanceexamples-2","status":"publish","type":"post","link":"https:\/\/e-ratepa.org\/?p=33555","title":{"rendered":"ECF Unmet Needs Documentation Guidance\/Examples"},"content":{"rendered":"<p><span style=\"color: #222222;\">August 17, 2021<\/span><\/p>\n<p>Attached:\u00a0<a href=\"https:\/\/e-ratepa.org\/wp-content\/uploads\/2020\/03\/Unmet-Needs-Library-Patron-Certification.docx\" target=\"_blank\">Unmet Needs Library Patron Certification<\/a>\u00a0(updated for ACP)<\/p>\n<p>Attached:\u00a0<a href=\"https:\/\/e-ratepa.org\/wp-content\/uploads\/2021\/08\/Unmet-Needs-Teacher-Certification.docx\" target=\"_blank\">Unmet Needs Teacher Certification<\/a><\/p>\n<p>Attached:\u00a0\u00a0<a href=\"https:\/\/e-ratepa.org\/wp-content\/uploads\/2021\/08\/Unmet-Needs-Parent-Certification.docx\" target=\"_blank\">Unmet Needs Parent Certification<\/a><\/p>\n<p>The FCC allowed schools and libraries to use \u2018reasonable estimates\u2019 when determining what to request on their ECF Form 471, but the rules are different at the ECF reimbursement stage.\u00a0 At this stage \u2013 whether you or your vendor are invoicing ECF \u2013 you must have documentation of unmet need for each student, teacher or library patron that is receiving ECF-supported Connected Devices and\/or internet access.\u00a0 We are conferring with the FCC to gather\u00a0<em>official<\/em>\u00a0guidance related to the documentation requirements, but because so many of you already have purchased and will be handing out devices and wi-fi hotspots in the next few days, I want to provide you with my best educated, yet unofficial advice related to this documentation.<\/p>\n<p>Also, I\u2019ve created the attached sample\u00a0<strong>Unmet Needs Certification Statements<\/strong>\u00a0for parents, teachers and library patrons that you can modify to meet your specific needs or incorporate into your back-to-school data-gathering requirements.<\/p>\n<p><strong>Schools<\/strong>:\u00a0 Generally, a school must have documentation of unmet need to support their ECF reimbursement request (with two exceptions as listed below).\u00a0 \u00a0\u00a0The evidence could be:<\/p>\n<p style=\"padding-left: 60px;\"><strong>a)<\/strong> A signed statement certifying the unmet need of the student or teacher.\u00a0 The statement must be signed by an authorized person (parent, legal guardian in the case of a student, or for devices assigned to teachers, the teachers\u2019 signature).\u00a0 Sample statements are attached.\u00a0 Or,<br \/>\n<strong>b)<\/strong> A survey response stating the student or teacher has an unmet need.\u00a0 If a school already conducted a survey, then a signed statement is not mandatory but is recommended as a best practice.<\/p>\n<p><strong>Libraries<\/strong>: Libraries are\u00a0<em>required<\/em>\u00a0to distribute an Eligible Use Policy and obtain a signed statement of unmet need from each library patron that checks-out a connected device or Wi-Fi hotspot.\u00a0 Attached is a sample certification statement that can be used or language that can be incorporated into your online checkout systems.<\/p>\n<ul>\n<li>Exception #1:\u00a0 A school that has a technical restriction that prevents a student or teacher from accessing the school\u2019s remote learning curriculum while off-campus unless the student or teacher uses a school-owned Connected Device\u00a0<strong><em>may<\/em><\/strong>\u00a0be able to rely on this technical restriction as the unmet need documentation on behalf of each student and teacher that receives an ECF-funded Connected Device.\u00a0 We are seeking guidance from the FCC whether this is sufficient or whether the school will still be required to obtain signed statement of unmet needs from students\/teachers.<\/li>\n<li>Exception #2:\u00a0 If a school is requesting reimbursement for Wi-Fi on buses, they are not required to obtain signed statement of unmet need from students as the lack of internet on the school bus where learning is occurring is a sufficient explanation.<\/li>\n<\/ul>\n<p><strong>Asset Inventory Reminder:<\/strong>\u00a0 When the device is distributed, the school or library must record in an asset inventory the following required elements:<\/p>\n<p><strong>&#8211; Connected Devices &#8211;<\/strong><\/p>\n<p>\u2714\u00a0\u00a0Device type (i.e., laptop, tablet, mobile hotspot, modem\/router)<\/p>\n<p>\u2714\u00a0\u00a0Equipment make and model<\/p>\n<p>\u2714\u00a0\u00a0Serial number<\/p>\n<p>\u2714\u00a0\u00a0Name of the person to whom the device was provided<\/p>\n<p>\u2714\u00a0\u00a0Dates the device or other piece of equipment was loaned out\/returned to the school or library<\/p>\n<p>\u2714\u00a0\u00a0If applicable, the date the school or library was notified that the device or other piece of equipment was missing, lost, or damaged<\/p>\n<p>\u2714\u00a0\u00a0For equipment located in school buses or bookmobiles, inventory also must include the name of the school or library employee responsible for that device; and the dates the device was in service (in addition to the device type, make\/model and serial number).<\/p>\n<p><strong>&#8211; Services &#8211;<\/strong><\/p>\n<p>\u2714\u00a0\u00a0Type\u00a0of\u00a0service\u00a0provided\u00a0(i.e.,\u00a0DSL,\u00a0cable,\u00a0fiber,\u00a0fixed\u00a0wireless, satellite,\u00a0mobile\u00a0wireless)<\/p>\n<p>\u2714\u00a0\u00a0Service plan\u00a0details,\u00a0including\u00a0upload\u00a0and\u00a0download\u00a0speeds\u00a0and\u00a0monthly\u00a0data\u00a0cap<\/p>\n<p>\u2714\u00a0\u00a0Name(s)\u00a0of\u00a0the\u00a0person(s)\u00a0to\u00a0whom\u00a0the\u00a0service\u00a0was\u00a0provide<\/p>\n<p>\u2714\u00a0\u00a0For\u00a0fixed broadband\u00a0service only, such as cable modem internet, the service address and installation date of service and\u00a0the\u00a0last\u00a0date\u00a0of service<\/p>\n<p>**\u00a0<strong>Unmet Need Definition:<\/strong>\u00a0 When a student does not have a sufficient\u00a0<strong>COMPUTER<\/strong>\u00a0and\/or\u00a0<strong>INTERNET ACCESS<\/strong>\u00a0for remote learning when not physically attending school.<\/p>\n<ul>\n<li><strong>Sufficient Computer\u00a0<\/strong>refers to a laptop, desktop or tablet that the student can use off-campus whenever they need to complete homework or attend online classes.\u00a0 A smartphone is not considered a computer.<\/li>\n<li><strong>Sufficient Internet access<\/strong>\u00a0refers to Internet connectivity that is reliable and enables the student to receive and send electronic information for homework and online classes.<\/li>\n<li><strong>Remote learning<\/strong>\u00a0includes off-campus educational activities while the student is not physically in a school building.\u00a0 Homework and virtual online classes are both considered remote learning.<\/li>\n<\/ul>\n<p>If you have any questions, please let me know.\u00a0 As soon as we receive official guidance on these issues, I\u2019ll post it to the listserve.<\/p>\n<p>&#8212;
