{"id":35611,"date":"2024-08-01T17:53:12","date_gmt":"2024-08-01T17:53:12","guid":{"rendered":"http:\/\/e-ratepaorg.local\/?p=35611"},"modified":"2024-08-02T17:56:37","modified_gmt":"2024-08-02T17:56:37","slug":"us-appeals-court-ruling-regarding-usf-incl-e-rate","status":"publish","type":"post","link":"https:\/\/e-ratepa.org\/?p=35611","title":{"rendered":"US Appeals Court Ruling Regarding USF (incl E-rate)"},"content":{"rendered":"<p><span style=\"color: #222222;\">August 1, 2024<\/span><\/p>\n<p>On July 24, 2024, the U.S. Circuit Court of Appeals for the 5th Circuit\u00a0<a href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/22\/22-60008-CV2.pdf\" class=\"mtli_attachment mtli_pdf\" target=\"_blank\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/22\/22-60008-CV2.pdf&amp;source=gmail&amp;ust=1722636990202000&amp;usg=AOvVaw2zyvIl-bViVp2slDuV9QUZ\">ruled<\/a>\u00a0that the current Universal Service Fund mechanism is unconstitutional.\u00a0 This decision creates a split amount the courts because the 6th and 11th\u00a0Circuit Courts previously deemed USF is constitutional in nearly identical cases brought by the same petitioners last year.
