{"id":35789,"date":"2024-11-12T21:33:45","date_gmt":"2024-11-13T02:33:45","guid":{"rendered":"https:\/\/e-ratepa.org\/?p=35789"},"modified":"2024-11-15T21:35:20","modified_gmt":"2024-11-16T02:35:20","slug":"category-1-form-470-bidding-and-eligible-services","status":"publish","type":"post","link":"https:\/\/e-ratepa.org\/?p=35789","title":{"rendered":"Category 1 Form 470\/Bidding and Eligible Services"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">November 12, 2024<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">~ C1 Eligibility and Form 470 Filing Guide Available ~<br>~ List of PA Applicants that May Need to File 470 for Recurring Services Available ~<strong><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Form 470 marks the start of the FY 2025 funding year because it opens the\u00a0competitive bidding process for equipment and services that aren\u2019t yet under contract for FY 2025 (July 1, 2025 \u2013 June 30, 2026).\u00a0 On the Form 470, schools and libraries identify and seek proposals for the products and services they need, and for which they will be requesting E-rate discounts, so that potential service providers can review those requests and submit proposals to you for consideration. An updated Form 470 Filing Guide for Category 1 services that provides complete step-by-step screenshots showing how to complete the Form is available at:\u00a0\u00a0<a href=\"https:\/\/e-ratepa.org\/wp-content\/uploads\/2024\/11\/Category-1-Form-470-Filing-Guide-FY-2025.pdf\" class=\"mtli_attachment mtli_pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Category-1-Form-470-Filing-Guide-FY-2025.pdf<\/a>. Category 2 eligibility and Form 470 filing instructions will follow.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Changes to FY 2025 Category 1 and Form 470<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Off-campus hotspots and related mobile wireless Internet services are eligible for Category 1 E-rate funding beginning in FY 2025.\u00a0 Complete information about this new initiative can be found at:\u00a0\u00a0<a href=\"https:\/\/e-ratepa.org\/wp-content\/uploads\/2024\/10\/Hot-Spot-Lending-Webinar-Oct-2024-PA.pdf\" class=\"mtli_attachment mtli_pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Hot-Spot-Lending-Webinar-Oct-2024-PA.pdf<\/a>.\u00a0 The FY 2025 Form 470 has been modified to include new Category 1 options for Hotspots Equipment and Service (must be bid separately) and the\u00a0<a href=\"https:\/\/e-ratepa.org\/wp-content\/uploads\/2024\/11\/Category-1-Form-470-Filing-Guide-FY-2025.pdf\" class=\"mtli_attachment mtli_pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Form 470 Filing Guide<\/a>\u00a0shows where to locate the hot spot equipment and service options on the new form.<\/li>\n\n\n\n<li>Although school bus Wi-Fi became eligible in FY 2024, the Form 470 was not updated to include this equipment\/service option.\u00a0 The FY 2025 Form 470 has been modified to now include new Category 1 options for School Bus Wi-Fi Equipment and School Bus Wi-Fi Internet Service (must be requested separately) and the\u00a0<a href=\"https:\/\/e-ratepa.org\/wp-content\/uploads\/2024\/11\/Category-1-Form-470-Filing-Guide-FY-2025.pdf\" class=\"mtli_attachment mtli_pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Form 470 Filing Guide<\/a>\u00a0shows where to locate the school bus wi-fi equipment and service options on the new form.<\/li>\n\n\n\n<li>The new Form 470 has added the functionality to allow RFP documents to be uploaded to an existing Form 470, even if no RFP document was originally uploaded.\u00a0 The system will also ask if this is a substantial change, and if you answer yes, the system will reset and extend your Allowable Contract Date by an additional 28 days.\u00a0\u00a0Find 470 > Related Actions > Add RFP Document<\/li>\n\n\n\n<li>Functionality has been added in EPC to allow you to cancel an existing Form 470 as long as it has not yet been cited on a funded Form 471.\u00a0\u00a0Find 470 > Related Actions > Cancel Form 470<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>FY 2025 Eligible Category 1 Services<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FCC has approved the&nbsp;<a href=\"https:\/\/docs.fcc.gov\/public\/attachments\/DA-24-1104A1.pdf\" class=\"mtli_attachment mtli_pdf\" target=\"_blank\" rel=\"noreferrer noopener\">FY 2025 Eligible Services List<\/a>&nbsp;(ESL), with the most notable change being the addition of Off-Campus Wi-Fi Hotspots for students, teachers and library patrons that lack sufficient Internet while off campus.&nbsp; The FY 2025 Form 471 filing dates have not yet been announced, but they are expected to be similar to last year \u2013 early January \u2013 mid-late March.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Note:\u00a0 If you are considering bidding Leased Dark Fiber (where you lease and light strands yourself) or Self-Provisioned Fiber (build your own network), please be sure to review the E-rate rules related to the extra bidding requirements related to these two services at:\u00a0<a href=\"https:\/\/nam10.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.usac.org%2Fe-rate%2Fapplicant-process%2Fbefore-you-begin%2Ffiber-summary-overview%2F&amp;data=05%7C01%7Cpl-erate%40lists.psu.edu%7C41cf48a0cda14726735808dbd6179e63%7C7cf48d453ddb4389a9c1c115526eb52e%7C0%7C0%7C638339169831165359%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C3000%7C%7C%7C&amp;sdata=x446MNnLzVM%2FeevqtFLK4Jlw8pgH4homcNNlxwv96MU%3D&amp;reserved=0\" target=\"_blank\" rel=\"noreferrer noopener\">fiber-summary-overview<\/a>\u00a0and let me know if you have any questions prior to bidding.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Understanding Which Form 470 Options to Select<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Form 470 service options are determined by your selections to multiple levels of options.&nbsp; They are designed to be descriptive options with progressive disclosures for Category 1 (meaning the form takes you to additional levels of questions, depending on the options you select).&nbsp; To make the options a little more understandable, the&nbsp;<a href=\"https:\/\/e-ratepa.org\/wp-content\/uploads\/2024\/11\/Category-1-Form-470-Filing-Guide-FY-2025.pdf\" class=\"mtli_attachment mtli_pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Form 470 Filing Guide<\/a>&nbsp;contains screenshots of the form with plain language annotations to help you select the appropriate option(s) \u2013 see slides 21-42.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>When Must a Form 470 be Filed?<\/strong><\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>If a service is covered on a Month-to-Month basis (meaning no contract), a new Form 470 is required\u00a0annually\u00a0(unless using the CABIO option).\n<ol start=\"1\" style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li>To understand CABIO and whether your services qualify, see:\u00a0\u00a0<a href=\"https:\/\/nam10.safelinks.protection.outlook.com\/?url=http%3A%2F%2Fe-ratepa.org%2Fwp-content%2Fuploads%2F2014%2F03%2FCABIO-Bidding-Exemption-Guide-FY-2024.pdf&amp;data=05%7C01%7Cpl-erate%40lists.psu.edu%7C41cf48a0cda14726735808dbd6179e63%7C7cf48d453ddb4389a9c1c115526eb52e%7C0%7C0%7C638339169831165359%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C3000%7C%7C%7C&amp;sdata=likLWVZD365COAq%2Bb9EdUycRrH3ZbEBp6JijUFCYxJY%3D&amp;reserved=0\" target=\"_blank\" rel=\"noreferrer noopener\">CABIO-Bidding-Exemption-Guide-FY-2024.pdf<\/a>.<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li>At the\u00a0beginning\u00a0of any new contract.\u00a0 Note:\u00a0 If you posted a Form 470 in a previous year, and then signed a multi-year contract that expires on or after June 30, 2026, you are\u00a0not\u00a0required to file a Form 470 for FY 2025.\u00a0 If you wish to exercise a voluntary extension of a contract without posting a 470, you may only do so if your original contract contains the terms of the voluntary extensions (meaning the exact number of years or dates that the extensions can be exercised and it&#8217;s not just open-ended). \u00a0Otherwise, you must post a Form 470 to extend the contract.<\/li>\n\n\n\n<li>If you\u2019re upgrading bandwidth mid-contract and the upgrades and associated prices are not included in the original contract (or making any other significant changes to your original contract).<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Who Must File a Form 470 for FY 2025?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Based on the contract expiration date that you listed on your FY 2024 Form 471 and whether you indicated in the Contract Record whether the original contract contained optional extensions, I\u2019ve created the&nbsp;<a href=\"https:\/\/e-ratepa.org\/wp-content\/uploads\/2024\/10\/FY-2025-C1-Bidding-Status.xlsx\" class=\"mtli_attachment mtli_xlsx\" target=\"_blank\" rel=\"noreferrer noopener\">FY 2024 Possible Category 1 Rebid List<\/a>. &nbsp;If you see that your contract expiration date (CED) is not accurate on the list, it likely means you entered it incorrectly on your FY 2024 Form 471.&nbsp; If this happened, simply use the correct CED on your FY 2025 Form 471 and if PIA asks about the change, you can simply provide them with a copy of your contract that shows the accurate CED.&nbsp; Alternatively, you can create a new Contract Record with the corrected dates and cite to that when creating your Form 471.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Form 470 RFPs:&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I encourage you to issue an RFP with your Form 470 to describe the services you want, minimum requirements for vendors, and possible disqualification factors, even if the RFP is just one-page.&nbsp; Doing so will give you the ability to them upload any RFP addenda, Q &amp; A, or additional information given to bidders using the \u2018Related Actions\u2019 feature in EPC when on the Form 470 page.&nbsp; However, this can only happen if an RFP was uploaded with the 470 initially.&nbsp; Important:&nbsp;&nbsp;When any of the services or locations change, or if you provide additional, substantive information to bidders, you must provide this to all bidders using an RFP addendum and then be sure that the bid due date is at least 28 days after the posting of that new information.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Deadline to File Form 470s<\/strong><br>Although the very last possible date to file a 470 is 29 days before the 471 window closes,&nbsp;do not wait&nbsp;this long to file.&nbsp;&nbsp;I encourage everyone to file their 470&#8217;s by Thanksgiving, if possible.&nbsp;&nbsp;You will then receive vendor questions\/proposals during the month of December, can evaluate your bids and select your vendors in January, have your board approve contracts in January or February (if required by local policy), and then sign your contracts and file your 471 in late February or early March.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Important Requirements\/Reminders:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>List bid due date in Form 470 or RFP<\/strong>.\u00a0 If such a deadline isn\u2019t stated, you must consider all bids received up until the date you conduct your bid evaluation.\u00a0 Therefore, I strongly recommend that all Form 470s\/RFPs include a vendor proposal due date (<em>be sure that this date is at least 29 days from the date this Form 470 is posted).<\/em>\u00a0<\/li>\n\n\n\n<li><strong>All disqualification reasons\u00a0<u>must<\/u>\u00a0be stated on the 470 or in the RFP\u00a0<\/strong>and must be able to be answered yes or no.<\/li>\n\n\n\n<li><strong>Upload RFP with 470.<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If you are using an RFP in addition to your 470, you must upload the RFP with the 470, AND upload any additional documentation given to bidders during the bidding process.&nbsp; If any of the new documentation materially changes the services being bid or entities served, you must ensure the deadline to submit bids is at least 28-days after the RFP addendum is uploaded into EPC.&nbsp; In light of this, you also may wish to consider adding 2 weeks to the 28-day clock to allow for initial vendor questions (set a deadline for those questions and then upload answers with the RFP).&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Installment Payment Plan with vendors.<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If you would like to spread out the non-discounted (the applicant\u2019s share) amount of the cost of special construction (installation), you must indicate so on the 470 under the \u2018Payment Installation Plan\u2019 section located beneath the narrative box.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Use State\/Local Procurement Requirements narrative box.<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is the space where you place instructions on bidders, such as the final date to submit bids (must be at least 29 days after 470 filing date), where to submit bids, in what format, if references are required, if vendors must have SPIN numbers, if you require discounted bills, etc.&nbsp; Use this space wisely!<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Hints for Form 470 Last Steps:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Viewing Draft 470 Before Filing<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">At the end of the form, the system will require you to select \u2018Review 470\u2019 and will say that it\u2019s generating the PDF.&nbsp; To see the PDF, you must click on \u2018Refresh\u2019 until it appears.&nbsp; The PDF will not appear unless you click Refresh (and sometimes it takes up to 30 seconds to appear).&nbsp; Review the draft and if you want to make changes to the form, click \u2018Back to re-enter the form.&nbsp; To submit, check on the certification box, and then \u2018Continue to Certification\u2019 to proceed with the certification\/submission.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Obtaining a Final, Submitted Copy of Your 470<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">After you&#8217;ve &#8220;certified&#8221; your Form 470, it&#8217;s often difficult to find a final copy.&nbsp; At the bottom of your Landing Page (home), scroll to the bottom where it says FCC Forms and Post-Commitment Requests.&nbsp; Select \u2018Form 470\u2019 and the funding year.&nbsp; Then click on the 470 Nickname that you gave the form and it will show you a summarized version of the 470.&nbsp; To download an actual copy, click on \u2018Generated Documents\u2019 on the top toolbar, and then \u2018Original Version.\u2019<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s important that you begin the Form 470 bidding process as soon as possible so you don\u2019t run out of time during the Form 471 application window.\u00a0\u00a0 If you have any questions about filing the Form 470, please e-mail me at\u00a0jtschell@comcast.net!<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Happy Filing!<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8212;
