{"id":36317,"date":"2026-08-14T12:53:06","date_gmt":"2026-08-14T16:53:06","guid":{"rendered":"https:\/\/e-ratepa.org\/?p=36317"},"modified":"2026-08-14T12:53:06","modified_gmt":"2026-08-14T16:53:06","slug":"fcc-nprm-proposing-major-changes-to-e-rate-program-now-published-in-the-federal-register","status":"publish","type":"post","link":"https:\/\/e-ratepa.org\/?p=36317","title":{"rendered":"FCC NPRM Proposing Major Changes to E-Rate Program Now Published in The Federal Register"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">August 14, 2026<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As previously mentioned, the FCC released two E-Rate Notices of Proposed Rulemaking (NPRMs) that could significantly impact the program and the administration of the Universal Service Fund (USF). \u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both have now been published in the Federal Register, which starts the initial 60-day public comment period, followed by an additional 30-day reply comment period.\u00a0 Based on today\u2019s release, initial comments are due on or before\u00a0<strong>Oct. 13, 2026<\/strong>, and reply comments are due on or before\u00a0<strong>Nov. 12, 2026<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The two NPRMs,\u00a0 &#8220;<strong>Ensuring Children\u2019s Safe Use of Screens and E-Rate-Funded Services\u201d\u00a0<\/strong>and \u201c<strong>Promoting Fair and Open Competitive Bidding in the E-Rate Program<\/strong>\u201d\u00a0<a href=\"https:\/\/www.fcc.gov\/document\/fcc-review-e-rate-program-ensure-congresss-vision\" target=\"_blank\" rel=\"noreferrer noopener\">(FCC-26-41)<\/a>, are premised on limiting student screen time in schools as a requirement to receive E-Rate funding.\u00a0 But the NPRM goes far beyond just screen time, proposing specific changes and seeking comments on dozens of program areas.\u00a0 For a list of all questions asked, go to\u00a0\u00a0<a href=\"https:\/\/e-ratepa.org\/wp-content\/uploads\/2026\/07\/All-Questions-from-FCC_26-41.xlsx\" class=\"mtli_attachment mtli_xlsx\" target=\"_blank\" rel=\"noreferrer noopener\">All-Questions-from-FCC_26-41.xlsx<\/a>:\u00a0\u00a0\u00a0 \u00a0\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Should the E-Rate program be limited or sunset to reflect today\u2019s extensive connectivity rates? (paragraph 12)<\/li>\n\n\n\n<li>Should CIPA compliance include [student] screen-time limits or monitoring? (paragraph 30)<\/li>\n\n\n\n<li>To what extent should schools be required to provide parental \u201copt-out\u201d of screen-based instruction or screen-use to receive E-Rate funding? (paragraph 31)<\/li>\n\n\n\n<li>Should funding be eliminated from applicants with the lowest discount percentages? (paragraph 25)<\/li>\n\n\n\n<li>Did Congress intend for the [FCC\u2019s] decisions about the E-Rate program to be based on educational outcomes? If so, how should the Commission measure educational outcomes? (paragraph 28)<\/li>\n\n\n\n<li>At what point should policymakers conclude that the program\u2019s core objective has been achieved?<\/li>\n\n\n\n<li>Does E-Rate support adopted in the 2014 Second E-Rate Order remain justified in light of today\u2019s school connectivity rates and the availability of other federal funding sources?<\/li>\n\n\n\n<li>Should E-Rate funding be phased out for schools and libraries in areas with the lowest NSLP participation rates, given the likelihood of greater resources and tax bases?<\/li>\n\n\n\n<li>Does continued support for self-provisioned network construction and dark fiber risk displacing private investment or wasting federal resources on duplicative infrastructure?
