Not Too Late to File Missing FY 2017 Form 486s

We have just learned that the FCC has granted USAC the discretion to approve late-filed Form 486 appeals as long as these two conditions are met:

  1. The Form 486s were filed no later than 120 days after the last date to receive service in the funding year (for FY 2017 recurring services, this date would be October 28, 2018);

and

  1. Where applicants have demonstrated good cause for the late filing (such as where the circumstances were beyond their control).

I have attached a list of FY 2017 recurring service FRNs where no Form 486 has been filed.  If you are on this list, please take the following steps immediately (before October 28, 2018).  If you already filed a late Form 486 for FY 2017 and USAC adjusted your Service Start Date less than 60 days ago, please also follow these steps (I doubt USAC will grant appeals filed more than 60 days after the date they notified you of your Adjusted Service Start Date, but it doesn’t hurt to try).

  1. File the Form 486 in EPC immediately.
  2. Within a few days, USAC will issue to you via EPC e-mail a Form 486 Notification Letter.  The last page of that letter will show a “120-day violation” and the new Approved Service Start Date.  If you file the 486 today, the ASSD will likely be around June 12, 2018 (which is about 120 days from today).
  3. Then immediately file an appeal in EPC, selecting the drop downs shown in the example below.  In the narrative box, fill in the XXXXs with an explanation of what circumstances prevented you from submitting the Form 486 on time, such as the person responsible for E-rate was no longer with the school or library during the time when the 486 was due and the late 486 notice was issued, etc.
  4. While the appeal is pending, file an Invoice Deadline Extension Request (IDER) in EPC to extend your FY 2017 invoice deadline.  This way, if and when USAC grants your appeal, you will still have time to submit your FY 2017 BEAR.  Instructions on filing an IDER request in EPC can be found at:  http://e-ratepa.org/?p=27331.
  5. As soon as USAC grants your appeal, file the FY 2017 Form 472 BEAR to collect your reimbursement.  Don’t forget, BEARs are filed in the legacy system – not in EPC (https://www2.sl.universalservice.org/bear/login.aspx).
